Clara Home Care Inc.’s ("Clara") Privacy Policy ("Privacy Policy") is designed to provide a clear understanding of the information Clara collects and how Clara uses it to provide its services and give users a better experience. It applies to any users of this web site (the "Site"), and any users of the services provided by Clara through the Site and via telephone, email and mail (collectively, the "Services"). By using the Site or the Services, you consent to the collection, storage, use and disclosure of your personal information and other information as described in this Privacy Policy.

  1. Information Collected by Clara. Clara collects both "personal information" and "personal information that it collects automatically" about users of the Site and the Services. Personal information that you provide to us through the Services may include your full name, email address, mailing address, and other information about you. Personal information that we collect automatically, may include passively collected information about your activities on the Site, such as usage data. Those who access and browse the Site without registering are referred to herein as "Site Visitors". All users who register with Clara are referred to herein as "Registered Users". All personal information provided to Clara by Site Visitors and Registered Users, whether through the Site or by phone, email or mail, will be stored by us, or an authorized third party data controller such as Auth0 by Okta or Bhalu Insurance. You represent and warrant to Clara that you have the right and authority to provide Clara with all personal information that you provide about yourself or others.

  2. How Clara Uses Personal Information. The personal information Clara collects is used (1) to perform and improve the Services, including, without limitation registering your account, setting up your accounts with taxing authorities such as the IRS, providing you with workers compensation insurance using our third party partners, and making transfers to and from your bank account and the bank account of your employees; (2) to enhance your experience with Clara, including, without limitation, providing customer services and technical support; (3) to assist Clara in verifying the identity of you and your employees; and (4) to help Clara to communicate with you.

  3. Technical Information. When you visit the Site, Clara receives the internet protocol ("IP") address of your computer (or the proxy server you use to access the internet), your computer operating system and type of web browser you are using. If you are using a mobile device, Clara may also receive your mobile device id (UDID), or another unique identifier, and mobile operating system. Clara may correlate this information with other personal information it has about you. Some browsers used to access the Internet may give you the option through “Do Not Track” settings associated with such browsers, to request that a website operator not track your information across its website or other websites. Clara does not guarantee that it will automatically honor such browser requests, but Clara will not use your information in a manner that violates this Privacy Policy. In addition, you retain the ability to opt out of certain information sharing as set forth herein.

  4. Cookies and Other Technologies. Like most websites, Clara and its service providers use cookies and tracking pixels to track Site usage and trends, customize your experience on the Site and improve the quality of the Services. A cookie is a tiny data file that resides on your computer, mobile phone, or other device, and allows Clara to recognize you when you return to the Site using the same computer (or mobile device) and web browser. You can remove or block cookies using the settings in your browser, but in some cases doing so may impact your ability to use the Site.

  5. Social Media. The Site may include social media features and widgets. These features may collect your IP address, the URL of the page you are visiting on the Site and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on the Site. Your interactions with these features are governed by the privacy policy of the company providing it.

  6. How Clara Uses Automatically Collected Personal Information. Clara may use the personal information it collects automatically to help it improve the Services and customize the user experience, such as by providing targeted useful features and promotions based on the type of Service you seek. Clara may also aggregate the information collected via cookies and similar technologies to use in statistical analysis to help Clara track trends and analyze patterns in the use of the Site.

  7. How Clara Shares Information. In addition to using the information collected by Clara for the purposes described above, Clara may also share your personal information with various third parties, as follows:

Clara shares personal information with third parties where you have instructed us to or provided your consent to do so, including financial institutions, your employees, the IRS, state and local tax agencies, insurance providers such as Bhalu Insurance, and software providers such as Symmetry Software.     Service providers. Clara shares personal information with vendors who perform services on behalf of Clara, including without limitation, vendors who perform verification checks and vendors who process credit and debit transactions.

    Authorities and others. Clara will share personal information as required by law or for reasons of safety.

    Business transferees. In the event Clara goes through a business transition such as a merger, acquisition by another company, or sale of all or a portion of Clara’s assets, your personal information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of Clara or that acquirer's affiliates may continue to process your personal information as set forth in this Privacy Policy.

    Professional advisors. Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.

    This Privacy Policy does not limit Clara’s use or disclosure of any personal information that it collects automatically, such as information passively collected from your computer via cookies, web beacons, or standard logging of website activity. If you do not wish to share this information with Clara, then you should take steps to limit the passive collection of data about your activities on the Site, for example, by changing your browser settings to disable cookies.

  8. Communications From Clara. By becoming a Registered User, you are consenting to receive certain email communications from us, such as special offers, tips and advice, notifications, customer surveys, and administrative notices. You have a choice at any time to stop Clara from sending you emails for these purposes by sending Clara an email at contact@clarahomecare.com. Please note that despite any indicated email marketing preferences, Clara may send you administrative emails regarding Clara, including, for example, notices of updates to Clara’s Privacy Policy or relevant tax or payroll information.

  9. Personal Information After Account Closure. If you close your account, Clara may, in accordance with applicable law, delete any or all of your account information without liability or Clara may retain information related to you for business purposes, if required by law or in connection with its normal document retention procedures.

  10. Collection of Information from Children. The Site and the Services are not intended for individuals under the age of 17. Accordingly, Clara does not knowingly collect, either online or offline, personal information from individuals under the age of 17.

Clara has implemented certain security safeguards designed to help protect your information, including, without limitation: (a) encryption of sensitive data as it is transmitted over public networks; (b) the use of encryption technology when sensitive data is stored by us; (c) the use of firewalls; and (d) password requirements. THERE IS NO GUARANTEE THAT YOUR INFORMATION MAY NOT BE ACCESSED, DISCLOSED, ALTERED, OR DESTROYED BY BREACH OF SUCH FIREWALLS AND SECURE SERVER SOFTWARE. BY USING THE SITE, YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND AGREE TO ASSUME THESE RISKS.

  12. Links to Other Websites. Clara may provide links to other web sites that Clara believes may be of interest to its users. However, Clara is not responsible for the privacy practices employed by those web sites, and Clara is not responsible for the information or content they contain. This Privacy Policy does not apply to such third-party web site, which may have its own privacy policy.

Shine the light law.  Under California’s Shine the Light law (California Civil Code Section 1798.83), California residents may ask companies with whom they have formed a business relationship primarily for personal, family or household purposes to provide the names of third parties to which they have disclosed certain personal information (as defined under the Shine the Light law) during the preceding calendar year for their own direct marketing purposes, and the categories of personal information disclosed. You may send us requests for this information to contact@clarahomecare.com. In your request, you must include the statement “Shine the Light Request," and provide your first and last name and mailing address and certify that you are a California resident. We reserve the right to require additional information to confirm your identity and California residency. Please note that we will not accept requests via telephone, mail, or facsimile, and we are not responsible for notices that are not labeled or sent properly, or that do not have complete information.

  14. Changes to the Privacy Policy. Clara reserves the right to change this policy at any time. You should periodically check the privacy policy on the Site for updates. Your use of the Site or the Services after such effective date will constitute acceptance by you of such changes.
